The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears and refund of the bond.

Should the tenancy be terminated?

Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986 (RTA).
Rent is at least 21 days in arrears at the hearing date. The tenancy is terminated. The landlord has provided rent records and confirmed that the rental arrears owing is $4,988.00 through to 3 December 2025.
The tenant did not dispute the rental arrears amount. They advised that; they had been through a difficult financial patch, they were expecting money in the future (it had just not been received yet); they expected to be able to clear the arrears in the future.
The tenant also submitted that there were several maintenance issues with the property, however, no application or supporting evidence has been provided in respect of these claims and so I was unable to consider these further.
The landlord had also made additional claims relating to the state of the property and alleged unsafe conditions. As the tenancy is terminated for rent arrears, I also have not considered these further.
The possession date was discussed, the landlord sought immediate termination due to the high level of rent arrears and the pressure this was placing on the owner. The tenant asked for one to two months before possession was granted.
There have been no rent payments since October. I have allowed the tenant until 7 December 2025 to move their family out of the property, but I cannot allow any further time given the level of rent owed. I note that the tenant remains liable for rent until they vacate the property.
