Reasons
- Ms Otter represented the landlord. The tenant did not attend the hearing. She was given the video link and an alternative phone number to join the hearing but failed to do so. I telephoned her. The call was answered but immediately disconnected.
- I am satisfied that proper notice of the hearing was given to the tenant.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears, refund of the bond and the filing fee.
Should the tenancy be terminated?
- Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy 1 .
- Rent is at least 21 days in arrears today. The tenancy is terminated.
How much does the tenant owe?
- The landlord provided rent records which prove the amount owing at the end of the current rent period, 25 December 2025.
- The tenant remains liable for rent until she vacates the tenancy. I have set the possession date as 2 January 2026 to allow for the Christmas period.
- The Tribunal notes the history of rent arrears on this tenancy. The Tribunal made a conditional termination order on 3 October 2025. While the tenant complied with that order, the rent fell into arrears again very soon after and rent has continued to accrue ever since.
- As the application is successful, I have reimbursed the landlord the filing fee.
