- The landlord attended the hearing, conducted via teleconference. Two calls to the tenant went unanswered. I was satisfied adequate service had completed and I continued with the hearing after the second call also went unanswered.
- The landlord has applied for compensation following the end of the tenancy.
- There was no bond record for the $214.00 as claimed in the application and this claim was withdrawn by the applicant after a clarification request from Tenancy Services.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. One area of lawn was very overgrown and the cost of $150.00 for the cutting is accepted.
- The landlord provided exit photos in support of the costs claimed for the cleaning of the garage and house. The costs are awarded in full.
- The landlord front-footed the original claimed cost for rubbish removal and reduced that at the hearing by 40%, given her subsequent review of the evidence. This concern mirrored my own initial thinking. I consider the reduced amount of $537.75 as now sought is commensurate with the evidenced effort. This is awarded.
- The claim for a repair to a cabinet door was withdrawn.
- The amounts ordered are proved.
