Reasons
- The hearing was conducted by phone. The landlord was represented by Ms Farrimonde.
- The tenants could not be reached by phone. The landlord was told by the tenant, Mr Deshpande, that he and the other tenant were being deported.
- There are email addresses for service on the tenancy agreement. These have been used to notify the tenants of the hearing. I am satisfied that they have been served. The tenants have not contacted the Tribunal about the hearing to provide updated phone numbers or ask to attend via video.
- The tenancy began on 27 March 2025. This was a fixed term tenancy, due to end on 26 March 2026.
- Ms Farrimonde said that in July, Mr Deshpande gave the landlord two days’ notice that he was being deported and said that Mr Dhamankar had already been deported.
- Ms Farrimonde told Mr Deshpande that there would be a break fee. The bond was signed over to the landlord, who explained that the bond may not cover all the costs.
- Ms Farrimonde provided records to show that the bond of $1840 was applied as follows: a. Break fees of $1327.10 b. Cleaning of 287.50 c. Balance of bond $225.40 applied to reduce the rent arrears.
- The balance of rent owing to 23 July 2025 is $1,614.60. That amount is ordered.
- Because Iron Bridge Property Management (Auck) Limited As Agent For Q & S Wilson has wholly succeeded with the claim I must reimburse the filing fee.
