I continued with the hearing in the tenant’s absence because they have been emailed notice of the hearing date and time to their address for service and been sent text reminders.

The landlord has applied for termination of the tenancy, payment of rent and water arrears and refund of the bond.

How much is owing for rent and water rates?

The landlord provided rent records which prove that:- a. Rent was at least 21 days in arrears on the date the application to the Tribunal was made (10 November 2025); b. All rent arrears were repaid on 24 November 2025; c. Weekly rent has been paid on time every week since then.

The landlord provided water rates invoices and payment records which prove that:- a. The amount owing for water rates was $989.70 on the date the application was made; b. An amount of $400.00 was paid towards water rates on 24 November 2025; c. Two additional water rates invoices have been charged ($92.31 in November and $76.03 in December); d. The amount owing for water rates is currently $758.04.

Should a conditional termination order be made?
