Reasons

The hearing was held by teleconference. The landlord attended. The Tribunal attempted to contact the tenant using the contact number provided but was unable to do so. The landlord advised that the tenant is currently incarcerated at the Auckland Women’s Corrections Facility. No representative for the tenant made contact with the Tribunal, and no further information was provided by the correctional facility. I am satisfied that the hearing notice was properly served and that the tenant was, or ought reasonably to have been, aware of the hearing. In those circumstances, it was reasonable to proceed with the hearing in the tenant’s absence.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
The tenancy commenced on 27 November 2024. The weekly rent is $159.00. The landlord applied on 12 November 2025 for termination of the tenancy under section 55(1)(a) of the Residential Tenancies Act 1986 on the basis that rent was at least 21 days in arrears at the time the application was filed. The landlord provided a rent summary showing that, as at the date of filing, rent arrears totalled $1,522.29.
At the hearing, the landlord advised that the tenant remained in custody and confirmed that, as at the date of the hearing, rent arrears had increased to $2,839.71. The landlord’s evidence establishes that rent was well in excess of 21 days in arrears when the application was filed and has continued to accrue.
The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord delayed termination to 12 January 2026. The landlord explained that they believe there may be persons occupying the premises at the tenant’s consent but were not authorised by the landlord, and that a short delay would allow appropriate arrangements to be made. Having considered the circumstances, I am satisfied that it is reasonable to grant termination effective from 12 January 2026. Given that the tenancy continues until that date and the premises have not been lawfully surrendered, I consider it reasonable to order rent up to 12 January 2026. On the landlord’s evidence, the total rent owing to that date is $2,953.29, and that amount is awarded.
The landlord has waived reimbursement of the filing fee. No order is therefore made in respect of the filing fee.
