Reasons
- The landlords attended the hearing. The tenant did not.
- I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend.
- On 12 November 2025, the Tribunal made an order relating to this tenancy, for rent arrears of $4850.00 and the filling fee of $28.00. The previous order is incorporated into this order for enforcement purposes. The amount still owing from this order is $4,528.00.
- The landlord has applied for termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee.
Should the tenancy be terminated?
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The tenant has been in rent arrears for some time and despite a 14-day notice being issued on 28 December 2025, the tenant has still not cleared the rent arrears of $4,500.00.
- The landlord provided rent records which prove the amount owing to 18 January 2026, including the remaining rent arrears from 12 November 2025 Order. This amount takes into consideration that s138(1)(a) of the District Court Act 2016, states that the landlord cannot enforce this eviction order for 48 hours. Therefore, they are unlikely to be able to take possession of the premise until Monday 19 January 2026. This gives the tenant time to move any belongings out of the premise that she wants to retain. The tenant will need to have her belongings out of the premise, the premise reasonably clean and tidy and the keys returned to the landlords by 9am on Monday 19 January 2026 or the landlords have stated they will apply for a bailiff to evict the tenant. Reimbursement of the filing fee
- Section 102(4) of the RTA confirms that applicants that are wholly or substantially successful in proving their claims will have their filing fee reimbursed.
- Because Livia Rachel Healey, Shayne Healey has wholly succeeded with the claim I must reimburse the filing fee.
