Both parties attended the hearing by telephone.
The tenant applied for compensation due to the landlord cancelling the tenancy agreement. The landlord opposed the application for compensation.
The parties signed a tenancy agreement on 12 July 2025. The tenancy was to commence on 29 July 2025 and was to be a fixed term until 29 July 2026. The weekly rent was $650.00 with a bond of $2,600.00.
On 17 July 2025 the tenant received a message from the landlord advising that she was going to have to cancel the agreement.
The landlord said that she cancelled the agreement because she made a mistake and due to misrepresentation by the tenant. At the hearing the landlord said that she did not know that she couldn’t cancel the agreement.
The issues raised by the landlord which she claimed the tenant misrepresented included that she was not married, she did not own the home with her previous husband, and she had previously smoked. None of these matters were relevant to the issue of whether there was any misrepresentation. It seems that the landlord failed to carry out due diligence prior to entering into the agreement.
Once a tenancy agreement is signed, it is binding on both parties. The landlord cannot unilaterally cancel the agreement unless both parties agree or there is a legal basis for cancellation. On the evidence there is no legal basis for cancellation.
The effect of the cancellation was that the tenant and her children had nowhere to live, and the tenant had to move to Greymouth to live for two weeks and travel back to Hokitika for work. The tenant is entitled to compensation for the losses that she suffered because of the landlord’s breach.
I have awarded compensation for the four days that the tenant and her children had to live in a motel which amounts to $480.00. I also award $400.00 which I consider is a reasonable amount towards the tenant’s travel between Hokitika and Greymouth over a two week period.
Because [The tenant/s] tenant/s] has wholly succeeded with the claim I must reimburse the filing fee.
