- Shardei Mere Arahia Te Karehu Pukeroa owes Accessible Properties New Zealand Limited $1,219.71 (“the debt”).
- Shardei Mere Arahia Te Karehu Pukeroa must pay rent and the debt as follows: a. By weekly payments of $223.00, being $203.00 for rent and $20.00 for the debt. b. Payments will be every Tuesday, with the first payment on 13/01/2026 and continuing until the debt is paid in full.
- Payments will be allocated in the following order: rent and then rent arrears.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 29 Dingadee Street, Welcome Bay, Tauranga 3112 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- Only the landlord attended the hearing. The tenant did not answer multiple calls to her cellphone.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The landlord said that the tenant wants to repay the debt to avoid immediate termination. She has paid weekly rent plus $7 towards the debt since 24/12/2025, but to have the debt paid within a reasonable timeframe the payments must be increased to $20 per week in addition to the rent of $203.
- The landlord is willing to continue the tenancy provided the tenant makes the minimum payments outlined in this order.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
- No request for reimbursement of the filing fee or name suppression was made.
- The landlord is to hand deliver a copy of this order. It will be emailed to the tenant but the email address is not an address for service so personal service is required to ensure the payments required can be set up before Tuesday 13/1/2026 as required.
