- The landlord attended the hearing by videoconference. The tenant did not attend. Two calls to the number given in the Notice of Hearing, which was properly served, went to voicemail.
- The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
How much is owed for rent?
- The tenancy was for a fixed term ending on 25 October 2025.
- The tenant advised the landlord on 14 October 2025 that, “My lease ends on 21 and I haven’t signed any papers to say I’d resign the lease.”
- A fixed term tenancy becomes a periodic tenancy at the end of the fixed term unless within the period from 90 days to 21 days before the fixed term ends, either party gives notice that they don’t want it to continue. 1
- This tenancy therefore did not end on 25 October but became periodic and the tenant needed to give 21 days’ notice to end it. 2
- That notice was given on 14 October so the tenancy ended on 3 November.
- The landlord has provided rent records proving the rent arears owed at that date.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. 3
- The tenant did not return the keys. The landlord is entitled to be compensated for the rekeying costs which are provided by the locksmith’s invoice provided.
- The landlord also claims compensation for the cost of cleaning and repairs at the premises after the tenancy ended.
- The only evidence provided to support those claims is an invoice from the owners, costing their claim.
- The landlord’s representative appearing today is not the property manager who managed the tenancy so does not have the necessary evidence to hand.
- Those claims cannot be approved.

- Because Michelle Greer Real Estate Limited as Agent for Aidan Mowat has succeeded with the claim I must reimburse the filing fee.
