The landlord has applied for a. termination of the tenancy, b. rent arrears, c. water rates, d. payment of the bond and e. reimbursement of the filing fee.

Should the tenancy be terminated?

The Tribunal shall make an order terminating the tenancy if satisfied that the rent was, at the date the application was filed, at least 21 days in arrears. 1 Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. I discussed the termination date with the parties, and it is to be Tuesday 20 January 2026

How much is owed for rent?

The tenant must pay the rent as and when it is due and payable under the tenancy agreement. 2 The landlord provided rent records which prove the amount owing at the end of the tenancy. I have made an order for rent arrears and rent to the termination date.

How much is owed for water rates?

The tenant is responsible for water consumption charges. 3
The landlord filed an amended application for water rates 4 days before the hearing. I declined to hear this claim given that it was not included in the original application and also because it appeared that the landlord had included the fixed charges for water rates in his claim. The tenant is not liable for the fixed charges. If the landlord seeks an order for water rates he will need to file a fresh application with all relevant invoices and clear information about how much he is claiming for the tenant’s water rates usage. The bond is to be paid to the landlord immediately to offset the amounts ordered Other claims 1 See section 55(1)(a) Residential Tenancies Act 1986. 2 See section 40 (1)(a) of the RTA. 3 See section 39 RTA.
The landlord also amended the claim to include damage and rubbish removal. The landlord did not specify any amount claimed. As these claims were also not included in the original claim I declined to hear these claims. Filing fee

Section 95A of the RTA relates to suppression orders. The relevant provisions state: (1)The Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case.... ...(4) The Tribunal may, on the application of any party to proceedings or on its own initiative, having regard to the interests of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published. (5) An order under subsection (4) may be made subject to any conditions that the Tribunal considers appropriate.
The landlord sought suppression and as the application is successful, I have made an order accordingly.
The tenant applied for name suppression, however given the level of rent arrears, the public interest in publication outweighs the tenant’s interest.
