This order replaces and revokes the Order dated 28 November 2025 under application 5389942.

The order for rent arrears in this order supersedes the Order dated 5 November 2025 (application number 5346144, 5356090) in respect of rent arrears only.

Reasons

The landlord attended the hearing in person.

The tenant did not attend the hearing. On 19 February 2026 the tenant applied for an adjournment due to having a full-time job and Tauranga and being unable to attend the hearing.

The adjournment request was forwarded to me on the day of the hearing on 25 February 2026.

Due to the short time between receiving the adjournment request and the hearing I did not had time to obtain the landlord’s position in respect of the adjournment request.

I declined to grant the adjournment because there was no evidence of the tenant’s work commitments and in any event this matter should be prioritised over work, particularly as it is a rehearing of an earlier hearing where the tenancy was terminated for significant rent arrears.

The tenant was phoned at the commencement of the hearing on the two phone numbers in the application form. She did not answer but the phone number ending in 222 did ring for a short time. The tenant was then phoned again approximately 45 minutes into the hearing but again she did not pick up.

The tenant was served with the application, therefore the hearing proceeded without her. Termination

The Tribunal shall make an order terminating the tenancy if satisfied that the rent was, at the date the application was filed, at least 21 days in arrears. 1 Rent was at least 21 days in arrears on the date the application was filed.

The tenancy is terminated.

How much is owed for rent?

The tenant must pay the rent as and when it is due and payable under the tenancy agreement. 2

The landlord provided rent records which prove the amount owing as at the hearing date. The rent arrears ordered reflect the discussion at the hearing that from 24/4/25-25/2/26 the tenant has paid $20,850 of a total rent due of $28,160 for this period. I have made an order for rent to be paid to the termination date.
