Only the landlords attended the hearing which was held by phone. [Landlord 1] appeared on behalf of both himself and [Landlord 2], and confirmed that he had authority to appear on her behalf.

There was no appearance by the tenant. The Tribunal called both numbers set out in the application but both numbers went to voicemail.

I am satisfied that the tenant has been served with the landlords’ application in accordance with the provisions of the Residential Tenancies Act 1986 and so the hearing proceeded in the tenant’s absence.

The landlords have applied for termination of the tenancy and for an order for rent arrears and reimbursement of the filing fee.

This claim concerns a fixed term tenancy that began on 11 April 2025 and was for a fixed term of one year.

The landlords have previously obtained an order for termination and rent arrears in relation to this tenancy but did not enforce the order as they instead entered into a payment arrangement with the tenant. Regrettably, despite an initial payment from WINZ and some regular additional rent payments, the tenant has not kept to the payment arrangement and rent arrears have continued to accrue and are now substantial.

The landlords sought termination on the basis of rent arrears but at the hearing said that the tenant appears to have now abandoned the property.

[Landlord 1] explained that a neighbour contacted the landlord on 28 December 2025 to say that the tenant appeared to be moving out. He then went to the property and confirmed that the tenant has left, leaving behind rubbish and some damage. Their attempts to contact the tenant have been unsuccessful but they did receive a text from the tenant in error (intended for someone else) and so are confident that the tenant has received their messages.

Should the tenancy be terminated?

Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 28 December 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

The landlord provided rent records which prove the amount owing at the end of the tenancy based on rent arrears to 20 July 2025 together with additional rent arrears to 14 January 2025 (taking into account all payments made from 20 July 2025 to date for rent and towards rent arrears) is $11,085.64.

I note that rent arrears to 20 July 2025 was $3,435.71, that WINZ made a direct payment to the landlord of $1,731.50 and the tenant made four payments of $60.00 towards the arrears. However the tenant then missed a rent payment entirely on 21 August 2025, made no further payments of $60.00 towards the arrears, and has not paid rent at all for the period 16 October 2025 to date.
