Reasons
- Only the landlord attended the hearing which was held by video conference.
- The tenant did not join the conference. The Tribunal telephoned the mobile phone number provided for the tenant but that call went to voicemail.
- I am satisfied that the tenant has been served with the landlord’s application in accordance with the provisions of the Residential Tenancies Act 1986 (RTA) and so the hearing proceeded in the tenant’s absence.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears and refund of the bond.
Should the tenancy be terminated?
- Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
- The landlord submitted a rent summary showing that the tenant missed multiple payments during the tenancy. The landlord served a 14 day notice on 29 October 2025 but the arrears were not remedied. The arrears have since increased.
- Rent is at least 21 days in arrears at the hearing date. The landlord’s rent summary shows that rent is just over 45 days in arrears.

- The landlord requested a possession date of 17 February 2026 to allow the tenant to make alternative housing arrangements and to move her belongings over the weekend.
- The landlord will meet the tenant to do an exit inspection at 12pm midday on Tuesday, 17 February 2026.
- The landlord said that if the tenant is unable to meet them at that time she should let them know, and if she needs to leave before midday on 17 February she can leave the key on the kitchen counter (ensuring that the door is locked when she leaves).
