Reasons
- On 19 November 2025, the landlord filed an application seeking rent arrears and reimbursement of the filing fee.
- The matter was first called on 14 January 2026 and the Tribunal granted the landlord’s application to amend their claim to include termination of the tenancy and refund of the bond.
- The hearing proceeded by way of AVL. Mr Nash Varghese, Property Manager, appeared for the landlord. The tenant did not appear. The Tribunal was satisfied the tenant was properly served with the notice of hearing and the case proceeded in their absence.
- At the hearing, the landlord confirmed that they no longer sought termination of the tenancy or refund of the bond. The tenant vacated the property on 13 February 2026 and the bond was refunded to the landlord on 23 February 2026. The bond was used to offset the rent arrears.
- The landlord seeks outstanding rent arrears and has provided rent records which prove the amount owing at the end of the tenancy. The amount claimed is ordered.
- The landlord provided the Tribunal with evidence in support of claims for compensation but did not pursue these matters. The landlord is not prevented from making a fresh application for compensation.
- Because Pride Property Management Ltd As Agent For Victoria Sarah Rebecca Pett has wholly succeeded with the claim I must reimburse the filing fee.
