Reasons
- The landlord, represented by Mr Woodbury attended the hearing that was held by video conference. The tenant did not seek to be admitted to the hearing. Information on the file provided an explanation as to why Mr Walker might not attend. Mr Walker was served notice of the hearing to his residential address which is correct under the Residential Tenancies Act, 1986.
- In the circumstances I decided to conduct the hearing in Mr Walker’s absence.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy is $2,128.57.
- Because Otautahi Community Housing Trust has wholly succeeded with the claim I must reimburse the filing fee.
