Mr Dorrian and Ms Masters, representing the landlord, attended the hearing by video conference. The tenant answered his phone, shouted and swore and then hung up. As the tenant was served, the hearing proceeded in his absence.

The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy.

The landlord said the tenancy ended on 30 September 2025.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The landlord said the tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.

The landlord’s compensation claim was for removal and disposal of rubbish in the amount of $957.28.

The landlord provided numerous detailed photographs, that they said were taken on 1 October 2025, the day after the tenancy ended, and showed all the rubbish and personal items the tenant left at the property, inside the property, in the garage and in the garden shed.

The photographs provided and highlighted by the landlord during the hearing included old paint rollers and paint, chairs, tables, mattresses, ladders, blankets, full bins, boardgames, hoses, masks, wood, kindling, old pillows, old armchairs and could, rusty car door, bed frames, gym equipment, lawnmower, old fridge, fans, old toolbox, toaster, books, toys, full dishwasher of dishes, full kitchen cupboards of food, food left on the kitchen bench, chicken wire and many other items and rubbish strewn throughout the property. The amount of rubbish left was significant, from the photographs provided.

The landlord provided an invoice for removing and disposing of the rubbish, in the amount of $1,575.50, which I consider is a reasonable cost for this given the evidence provided. However, the landlord explained that they are only claiming $957.28 from the tenant as the balance of the bond they received covered $618.22 of this invoice for rubbish removal and disposal.

The landlord said they received a total bond of $2,320.00, from which costs were deducted for new locks, cleaning, rent arrears, plastering and painting some damage and new batteries for the garage remote, as well as $618.22 of the rubbish removal invoice, which all came to the bond amount of $2,320.00. The landlord said this is why they are only claiming $957.28 for the balance of the rubbish removal and disposal invoice.

I find that, given the evidence provided by the landlord, particularly the photographs, the tenant did not leave the property in a reasonably clean and tidy condition and left a significant amount of rubbish that had to be removed and disposed of by the landlord. I find the cost claimed by the landlord to be reasonable given the evidence, and so award the landlord $957.28 for rubbish removal and disposal.

Because Quality Rental Management Limited As Agent For Antony & Toni Joll has wholly succeeded with the claim I must reimburse the filing fee.
