Reasons

- The tenancy commenced on 17 June 2025 and was for a fixed term of one year.
- With the agreement of the landlord, the tenant vacated the tenancy early. The landlord secured a new tenant, commencing 10 October 2025.

How much is owed for rent?
- I am satisfied the tenancy ended early and I consider the tenant liable to pay rent up until 10 October 2025 when I accept the new tenants moved in.
- The rent summary wrongly included a rent guarantee payment made by the landlord to the owner in the sum of $1440. This sum was not a payment by the tenant at all and should not have appeared in the rent summary. When it is removed from the summary it is clear the correct amount of rent owing is tht ordered above.
- The total amount owing for rent is therefore as ordered above.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. .
- The tenant did not leave the lawns trimmed and tidy. She explained she could not get to the property to do them as she is a caregiver for others.
- I am satisfied that the sum ordered above is a reasonable compensation to the landlord for their work done to tidy the lawns.
Is the tenant liable to pay for the diesel?
- The property has a diesel tank and it was full at the outset of the tenancy.
- The tenancy agreement obligated the tenant to pay for all outgoings. I consider this included paying for the use of that diesel, and indeed during the tenancy, the tenant did arrange for the tank to be refilled and paid for.
- The tenant said she was told the diesel in the tank would last a year, yet she had to have it refilled after only a few months. She claims it heated everything in the house, including the water.
- The landlord said he saw diesel stains on the driveway, and suspects diesel was being siphoned off. He said he personally has seen the hot water tank at the property and it is powered by electricity. The diesel is only used for heating the property.
- I accept the landlord’s evidence. The landlord presented as a clear and reliable witness. He had a good memory of the events and gave his evidence in a considered and dispassionate way. I note the tenant did not challenge the landlord’s evidence that diesel was siphoned off. She offered no corroborating evidence regarding her version of events.
- I find that the tenant agreed to pay for the diesel she consumed. I accept the diesel was full at the beginning of the tenancy and empty at the end. I accept the landlord’s claim as to the amount spent to fill the tank as ordered above.
- Because Bay Asset Management Ltd T/A Propertyscouts Hawkes Bay As Agent For Brendon Dawson (Dbhb Ltd) has wholly succeeded with the claim I must reimburse the filing fee.
