The landlord attended the hearing. The tenant did not.

I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend.

The landlord has applied for possession of the premises for abandonment, reimbursement of the filing fee and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 26 September 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The person the tenant had sublet the self-contained sleepout to, informed the landlord that the tenant and another person in the main house had engaged in some unlawful conduct and the tenant had been incarcerated and had not been back to the premise since. The landlord’s attempt to locate him have all be unsuccessful.

The landlord visited the premise last night and confirms the sublet tenant has moved out of the sleepout and there is no one living in the main house. The main house has been left in a dishevelled state with broken old furniture and rubbish strewn all over the inside and outside of the premise. This is clearly visible from outside the premise itself.

Because the premises have been abandoned, and rent is in $16,600.00 arrears, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice. Disposal of goods

The landlord is unable to contact the tenant.

It is not practicable for the landlord to the return the goods to the tenant as he does not know the tenant’s whereabouts and the only information, he has is third hand. That information suggests he may be in prison.

The value of the goods is below the cost of storing, transporting and selling them. Therefore, the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986. Reimbursement of filing fee
