Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit 1 .

The tenant accepted the landlord’s claim for key replacement. I allow that claim by consent.

The tiles and grout on the sunroom floor required cleaning due to the smell of dog. The tenant accepted that he had a dog at the premises. He said the floor required sealing every 3 years otherwise it would absorb odours, something that had not been done.

The Tribunal received no evidence that the state of the floor in the sunroom was due to any failure by the landlord. It was the tenant’s responsibility to leave the premises reasonably clean. The photos and invoice produced by the landlord in evidence prove the claim for the cleaning of the sunroom floor.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission 2 .

The landlord has claimed the cost of repairing and reinstalling the clothesline. The tenant said that the clothesline became unscrewed from its base fitting, something he neglected to fix before he vacated the tenancy, after which he was not allowed back to remedy. 1 See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA) 2 See sections 40(2)(a), 41 and 49B RTA

I have assessed the landlord’s photographic evidence. I find that the dislodgement of the clothesline and the repairs (the tightening or replacement of the lines) is more appropriately considered a repair and maintenance issue for which the landlord is responsible. The landlord has not proved that the tenant caused damage to the clothesline; the required repairs probably arose through normal use and a simple displacement of the line from its base. I do not find this claim proved.

I have incorporated the filing fee awarded to the landlord at the hearing of the last application when the Tribunal terminated the tenancy by consent 3 .

As this application is successful, I have reimbursed the landlord the filing fee. Result

The tenant will pay the landlord $242.38 from the bond. The balance of the bond will be paid to the tenant.
