The tenancy terminated at 12 noon on 23 February 2026 pursuant to my order dated 30 January 2026. The tenants have not yet moved out. Ryan Davis says this is because they have nowhere to move to.

The landlord has applied for a warrant of eviction and is waiting for enforcement action to be taken.

Rent is payable in full until the tenants move out or are evicted.

The tenant says he does not think he should have to pay the water bills owing because there were water pressure issues and repeated water leaks.

The Tribunal made factual findings in the previous proceedings that there had been four water leaks between September 2024 and 31 July 2025. The landlord and tenant agree there has been another recent leak, in February 2026.

There is no evidence before me about water pressure problems, so I do not take this into account.

The tenants are not liable to pay for water lost through leaks caused by a known maintenance issue at the property. 1 There is no information available to assist me to assess how much water may have been lost. I consider it reasonable to credit the tenants 15% of the total water usage to recognise the leaks.

The total bills awarded is $874.23 and the credit to the tenants is $131.13. Bond, filing fee, suppression of names

The landlord has succeeded in the claims so I must award the filing fee.

The total amount owing by the tenants is greater than the bond, so the bond is refunded to the landlord in full immediately.

The balance owing by the tenants to the landlord is $2,778.08.

The landlord names are suppressed as its claims are successful and there are no conduct reasons to refuse this in these proceedings.

The tenants’ names are not suppressed. There is money owing for rent and water bills, so the public interest outweighs the tenants’ interests.

As I advised in the hearing, the landlord can request that any court enforcement fees be added to the total amount owing. 2
