- The landlord attended the hearing, which was conducted via video. There was no appearance for the tenant.
- The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
- The tenant had signed a fixed-term lease commencing on 17 November 2025. On the morning of the start of the tenancy, the tenant emailed saying that he could not move in.
- The landlord explained that because it was a fixed term lease, he was obliged to pay the rent until new tenants were found. The landlord was able to secure new tenants promptly and there tenancy started on 14 December 2025. Therefore, the Mr Oswald is liable for all rent up to and including 13 December 2025.
- Although the landlord did not apply for termination, I have terminated the tenancy and granted possession to the landlord. The landlord provided evidence that the tenant did not want to continue with the tenancy. He has been relieved of his obligations and also has no further rights in relation to the tenancy.
- Because Edinburgh Realty Ltd As Agent For Dennis & Lea Chamberlain has wholly succeeded with the claim I must reimburse the filing fee.
