Mr Stockdill appeared for the landlord.

The property is a cabin provided by the landlord for residential purposes. The tenancy commenced on 07 September 2020 and is periodic. The tenant resided at the property with another occupant. The other occupant is not named as a joint tenant.

The landlord states that on or about 15 September 2025 they received advice from a close relative of the tenant that the tenant had passed away. The landlord did not take steps at that time to bring the tenancy to an end and has not entered into a new tenancy agreement with the remaining occupant.

The rent summary provided shows that prior to passing away the tenant was in rent arrears, although additional payments appear to have been made in an attempt to remedy the arrears.

On 27 November 2025, the landlord filed a claim for termination of the tenancy for rent arrears of at least 21 days. The landlord seeks release of the bond, and a monetary order against the estate of the tenant for the balance owing. Law

Section 55(1) of the Residential Tenancies Act 1986 (The “Act”) provides that if the rent is more than 21 days in arrears at the time the application is filed, the Tribunal must terminate the tenancy.

Section 55(1A) of the Act provides that the Tribunal may, instead of making a final order under 55(1)(a), issue a conditional termination order if it is satisfied the tenant will repay the arrears within a specified period and that a similar breach is unlikely to occur again. Analysis and decision

In this case I am satisfied that the rent owing was at least 21 days in arrears at the time the application was filed.

Although the landlord initially sought a conditional termination, such an order is not appropriate in this case. The tenant is deceased and any liability for rent rests with the tenant’s estate.

The landlord does not seek immediate possession of the premises and seeks that possession be deferred until 10 February 2026. This is to allow time for the landlord to attempt to resolve the situation with the remaining occupant, including the possibility of entering into a new tenancy agreement.

Accordingly, the tenancy is terminated, and possession of the premises is granted to the landlord at midnight on Tuesday 10 February 2026. Costs

As the landlord has been wholly successful, I order reimbursement of the filing fee. Name suppression

Section 95A of the Act provides that on the application of a party that has been wholly or substantially successful in proceedings, the Tribunal must order that the parties’ name or identifying particulars not be published, unless the Tribunal considers that it is in the public interest to publish the names of the parties, or is justified because of the parties’ conduct, or any other circumstances of the case.

Although the landlord has been wholly successful, they do not seek name suppression.

Section 95A (4) further provides the Tribunal, on the application of any party to the proceedings, or on its own initiative, having regard to the interest of the parties and the public interest, may order that all or part of the evidence, or the name or any identifying particulars of any witnesses or party, not be published.

I am satisfied that the facts and reasoning of this decision are in the public interest, I am not satisfied that this interest necessarily extends to the name of the deceased tenant.

Having regard to the circumstances, including the fact that the tenant is deceased, and that resolution may be reached with the remaining occupant, I am satisfied that there are sufficient grounds to depart from the principle of open justice and to exercise the discretion in subsection 95A (4).

Accordingly, the Tribunal orders suppression of the tenant’s name.
