How much is owed for rent ?
- The tenancy was terminated by the Tribunal on 16 October 2025 for abandonment. The landlord provided rent records which prove the amount owing at the end of the tenancy.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA).
- The tenant did not remove all rubbish at the end of the tenancy.
- The landlord made separate claims for internal rubbish, external rubbish and removal of 6 tyres. I am satisfied that the landlord has proven that the amounts claimed for internal rubbish and removal of tyres are reasonable.
- The landlord claims $1812.04 for removal of external rubbish. The landlord’s photograph’s support its claim that there was 11m³ of rubbish and belongings left at the premises other than in the house at the end of the tenancy. However I am not persuaded that the amount claimed is the reasonable cost of removing the rubbish.
- I find the reasonable cost to be $1,150.00. In making this determination I have considered the cost of a 12m³ skip bin delivered to site, the cost of labour to remove the rubbish from the house and place it in the bin, and travel costs for those doing the work to travel to the tenancy premises. In determining the reasonable cost I have considered that the cost of disposing of the fridge left outside the premises is in addition to any rubbish/belongings placed into a skip bin. Other matters
- The landlord had properly attempted to make an additional claim for damage to a shed. However at the hearing the landlord withdrew this claim.
