Reasons
- The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenant, nor any call in to the conference by one of the telephone numbers provided on the Notice of Hearing. I was satisfied adequate service had completed and I continued with the hearing.
- The landlord has applied for rent arrears and compensation for rubbish removal, following the end of the tenancy.
How much is owed for rent?
- The tenancy ended on 17 October 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy was $177.71.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The landlord claims the tenant did not remove all rubbish.
- In support of this the landlord provided pre and exit photos. The compensation claimed was $358.50 for removal and disposal of external items and $656.84 for items under the house.
- The landlord sent some further photos prior to the hearing and while the tenant did not appear at the hearing she did respond to that email, saying that the external rubbish was from “fly tipping”. This was considered and the landlord, after further consultation with local management, withdrew the claim for costs incurred in the removal of the external items. That left the remaining claim of $656.84, based on 4m 3 volume of removed items for disposal, to be determined.
- Further discussion ensued as some of those items appeared more related to the be wood left by repairs or replacement of some fencing, decking, and balustrades completed just immediately prior to this tenancy. Time was spent looking at comparative photos but that was not conclusive.
- Having considered the evidence, I find an appropriate allocation of household items/rubbish to the tenant to be 2.5m 3 . That results in the tenant cost liability being revised to $410.53. That appears reasonable.
- The amounts ordered are proved.
