On 27 November 2025, the landlord filed an application seeking termination of the tenancy for rent arrears, refund of the bond and reimbursement of the filing fee.
The hearing proceeded by way of video conference. [Property Manager], Property Manager, appeared for the landlord. The tenants were joined to the hearing by telephone after their video link stopped working. Relevant legal considerations
The relevant law that applies is found in the Residential Tenancies Act 1986 (the “Act”).
With any claim before the Tenancy Tribunal, the Tribunal applies the usual civil law standards and expectations.
That includes a requirement that the party bringing the claim (the applicant), establish their claims “on the balance of probabilities.” The balance of probabilities means more likely than unlikely, or in mathematical terms, has a fractionally more than 50% likelihood. The Tribunal does not need to be certain or very sure about any claim, only that what is claimed is likely.
This obligation carried by the applicant is referred to as the “burden of proof.” Independent witnesses, corroborating documents and photographs are an important part of discharging this burden.
As noted by the District Court in Kaipo v Clarke & McCarthy (DC) TT233/02, in practical terms this means that: ... [L]ike anyone who brings an application before a Tribunal or Court, it is incumbent upon the applicant to provide the evidence necessary to prove the case. If the applicant fails to do that, then their application will be dismissed whether it has merit or not because it is up to the applicant to provide the necessary evidence. Ms Williams previously occupied the property as a joint tenant with another family member. Following the end of that tenancy, Ms Williams and Mr Campbell entered into a new fixed term agreement to rent the property. The tenancy agreement was signed on 5 September 2025 with the new fixed term commencing 11 September 2025 and expiring on 10 September 2026.

Should the tenancy be terminated?

Section 55(1)(a) of the Act states that the Tribunal shall make an order terminating the tenancy if the Tribunal is satisfied that the rent was, at the date on which the application was filed under section 86, at least 21 days in arrears.
The landlord provided an up-to-date rent summary which proves the amount owing. At the date of filing the tenant’s rent arrears totalled $5,398.58. Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated.
The rent records prove the amount owing at the date of hearing total $11,499.29. The amount claimed is ordered.
The tenants claim Work and Income New Zealand (WINZ) have been paying their rent directly to the landlord through a benefit redirection. The tenant’s questioned how the arrears were so large and challenged the validity of the rent records. However, the tenants were unable to provide their own evidence of rent payments. The tenants would like time to be able to apply to WINZ for financial assistance to make a lump sum payment to either clear a portion or a whole of the arrears in the hope they can remain in the property.
The landlord told the Tribunal that they have made multiple attempts to work with the tenants and WINZ to clear the arrears. The landlord said that should the tenants successfully apply for financial assistance and make a lump sum payment clearing or significantly reducing the arrears, they may not proceed with termination of the tenancy.
The Tribunal discussed making a conditions termination order. However, given the level of arrears the landlord did not support the making of such an order.
The landlord seeks possession of the property at midnight on Thursday 19 February 2026. This will provide the tenants with an opportunity to make an application to WINZ to clear a portion of their arrears. The landlord has offered to support the tenants to make the application.
Having heard from the parties and considering all of the evidence the Tribunal finds that it is appropriate to grant the landlord possession of the property from midnight on Thursday 19 February 2026.
