- Both parties attended the hearing via remote teleconference.
- The landlord has applied for termination of the tenancy, rent and water arrears and refund of the bond.
- The tenant resides at the property with her husband and 4 children and explained that she has been trying to withdraw their Kiwisaver funds to pay the debt. The rent arrears are significant and continue to increase each week.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- The landlord also provided an updated rent ledger during the hearing. Having sighted the landlord’s evidence I am satisfied that the tenant is responsible for the rent debt.

- The landlord advised during the hearing that they will file a new application in respect of the outstanding water charges.
- Because The Worx Property Management Limited As Agent For Gurman Properties Ltd has substantially succeeded with the claim I have reimbursed the filing fee.
