Both parties attended the hearing. Conducted via video conference. Ms Tahere had technical issues during the hearings and alternative attempts to join her by calling two known numbers (and as confirmed by her) were not answered. A part of the difficulty she had while in conference was a confrontation with a neighbour regarding the use of electricity as she had joined the hearing while charging her phone in a common area.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by failing to adhere to body corporate rules regarding the use of electricity in common areas, rubbish in common areas, noise, and ensuring building access is secure.

The landlord served the first 14-day notice on the tenant on 13 October 2025 and a second on 24 November 2025, and the tenant has not remedied the breaches within the required periods.

The landlord application was lodged on 3 December 2025 but since then there have been a series of further breaches, subject to formal notices from the body corporate, with supporting CCTV evidence. The continued use of common area electricity was confirmed today during the hearing.

It would be inequitable to refuse to terminate the tenancy because of the range of breaches repeated over an extended period. Ms Tahere expressed some awareness of the problems and acknowledged the problems caused by some visitors.
