Reasons
- Both parties attended the hearing. Quintal Jetson appeared for the tenants. An unsuccessful call out was attempted to Linda Jensen (Guarantor) after no appearance by her. Quintal confirmed Linda was aware of the hearing.
- The landlord has applied for termination of the tenancy, rent arrears, outgoings, and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent and electricity records which prove the amounts owing at the end of the tenancy. Quintal agreed that both totals, as ordered, were due.
- Because Suzanne Barnaby and Warren Barnaby have wholly succeeded with the claim I must reimburse their filing fee.
