Both parties attended the hearing which was held by videoconference/ teleconference.
The landlord has applied for refund of the bond and reimbursement of the filing fee following the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy a tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. 1
After the tenancy ended the landlord had cleaning work undertake at a cost of $603.75. Work was done to remove adhesive stickers from doors and to remove some rubbish from the section.
The property manager says that the owner paid for carpet cleaning and a deep clean of the bathroom but those costs are not proved or included in this claim.
The exit inspection photographs show that for the most part the premises were left in a reasonable condition. The photos do show however that some surfaces were not left reasonable and the landlord should be compensated for the cost of removing the stickers and items from the exterior.
The tenant’s obligation is to leave the premises in reasonable condition, not “market ready” for a new occupancy. Some costs, for instance cleaning the outside windows after a 2 year tenancy are costs the landlord should reasonably meet.
Weighing those considerations I find that it would be reasonable to require the tenant to make a contribution of $600.00 towards the costs incurred by the landlord in cleaning the premises at the end of the tenancy.
The whole of the tenant’s bond remains held at the Bond Centre. I have noted my concern that there is no reason a tenant should have the part of the bond the landlord has no claim against, withheld from them. The landlord should have ensured that uncontested part of the bond was released. 1 See s.40(1)(e)(ii)-(v) RTA
Because [The applicant/s] has substantially succeeded with the claim I must reimburse the filing fee.
