Ms James appeared for the landlord by video. There was no appearance by the tenant.
The tenancy is a boarding house tenancy. It commenced on 25 July 2025. The landlord gave the tenant 48 hours to vacate the property due to rent arrears, and the tenancy ended on 16 November 2025. On 07 January 2026, the landlord filed a claim for rent arrears and compensation for cleaning and damage to a window and a Venetian blind. Rent
The tenancy agreement uploaded with the application records the rent as $315.00 per week. In the application, it is recorded as $380.00 per week.
The landlord stated that on 31 July 2025 the tenant moved to another room, and the rent increased from $315.00 to $380.00 per week. The landlord provided a letter sent to the tenant recording this variation and referred to the increased payments shown in the rent summary.
The landlord’s rent claim is greater than I calculate. From 25 July 2025 to 30 July 2025, the rent was $315.00 per week. From 31 July 2025 to 16 November 2025, the rent was $380.00 per week. The total rent due for the period was $6,187.14.
The landlord stated that the tenant paid $5,690.00, which included a bond of $315.00. The bond was not lodged. Accordingly, I treat that payment as rent. The rent arrears owing is $497.14. Cleaning and damage
The landlord seeks $120.00 for cleaning, $601.45 to replace a broken window, and $258.00 to replace a damaged Venetian blind.
The landlord has produced a pre tenancy checklist stating that the room was in a reasonable condition at the commencement of the tenancy. It has been signed by the landlord but not by the tenant. It is unclear whether the checklist is for the first or second room occupied by the tenant.
The landlord has produced invoices for the window and the blind. No invoice has been provided for cleaning.
Prior to the hearing, I requested the landlord confirm that all evidence had been provided. The landlord confirmed that it had and re submitted the same material.
The landlord was unable to provide any photographic evidence. The landlord submitted that the invoices should be sufficient, as the items would not have been replaced if they had not been damaged Law
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii) -(v) of the Residential Tenancies Act 1986 (Act)
The Act does not require the premises to be provided or returned in a spotless or an immaculate condition. The standard is based on what an average bystander would consider reasonable, and not on the subjective opinions of the landlord and tenant. Determining whether the tenant has failed to leave the property reasonably clean and tidy, and remove all rubbish, will involve an objective assessment.
To succeed with a claim for damage the landlord must prove that damage occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. See sections 40(2)(a), 41 and 49B of the Act.
Determining whether damage has occurred during the tenancy will involve making an objective before and after assessment. Analysis and decision
The onus of proving these claims rests with the landlord. The standard required is on the balance of probabilities. The landlord must establish more likely than not that the tenant has breached the terms of the agreement or provisions of the Act.
At the conclusion of the hearing, the landlord asked whether further evidence could be submitted if it was located. I declined this request. The tenancy ended in November 2025, and the application was filed on 7 January 2026. Unless there are good reasons for not doing so, the Tribunal expects parties to have all evidence supporting their claims available at the time of the hearing.
There is no evidence upon which to make an objective assessment of the cleanliness of the property at the commencement or at the end of the tenancy. It is also unclear as to whether the pre tenancy checklist relates to the room occupied by the tenant for the majority of the tenancy.
There are no photographs of the damaged window or blind. The landlord’s submission that the items would not have been replaced if they were not damaged is insufficient evidence. The Tribunal must be able to make a proper objective assessment based on the evidence.
On the evidence, I am not satisfied that the tenant has failed to leave the property reasonably clean or that the tenant is responsible for damage.
The claims are dismissed. Costs
Because Kingsland Lodge Limited has partly succeeded with the claim I have reimbursed the filing fee. Name suppression
The landlord seeks name suppression.
Section 95A of the Act provides that on the application of a party that has been wholly or substantially successful in proceedings, the Tribunal must order that their name or identifying particulars of that party not be published, unless the Tribunal considers that it is in the public interest to publish the names of the parties, or is justified because of the parties’ conduct, or any other circumstances of the case.
The landlord has not been wholly or substantially successful and no orders are made.
Section 95A (4) provides the Tribunal, on the application of any party to the proceedings, or on its own initiative, having regard to the interest of the parties and the public interest, may order that all or part of the evidence, or the name or any identifying particulars of any witnesses or party, not be published.
Although the tenant has not appeared, they have been substantially successful, and I order suppression of their name.
