Reasons
- Ms Eder for the landlord attended today’s hearing. The tenant did not attend. The tenant was called on the phone number in the application, but the call was not answered. I am satisfied that the tenant was advised of today’s hearing and have proceeded in her absence.
- The landlord has applied for compensation for cleaning, rubbish removal and repair of wardrobe door following the end of the tenancy.
- The tenancy ended on 28 October 2025. The tenant had overpaid rent by $25.71 and that amount is credited to her.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
- The landlord provided me with the inspection report and photographs showing the condition of the property at the end of the tenancy. The tenant had left furniture and her belongings in the property and had not cleaned the property.
- The landlord provided copies of the costs it incurred in removing and disposing of the tenant’s belongings and rubbish and cleaning. I consider that those costs are reasonable for the work that had to be completed, and I award the landlord those costs.
- The amounts ordered are proved.
Is the tenant responsible for the damage to the premises?
- A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
- I am satisfied that the tenant damaged the wardrobe door during the tenancy, because it was off its rails in the final inspection report photographs. This damage is more than fair wear and tear and the tenant is responsible for the costs of repair.
- The amounts ordered are proved.
