Reasons
- The landlord attended the hearing, the tenant did not attend. I rang the tenant twice on her mobile number, but it went unanswered.
- However, the tenant had emailed the Tribunal before the hearing to advise that she is having to work and will not be able to answer the call. Also, the tenant confirmed the arrangement that she has with the landlord to repay the debt.
- This order represents the agreement that the parties have, and the tenant has been paying the rent and arrears as agreed for some months now.
- The landlord has applied for termination of the tenancy and rent arrears. The tenant wants to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- The tenant has been paying her rent and the rent arrears consistently for months now. She has shown that she is willing to repay the debt and remain in the home.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Rent arrears:
- The landlord has applied for rent arrears and has provided rent records which prove the amount of $2578.06 owing to 25 February 2026.
- I am satisfied that the landlord has proven their claim for rent arrears. Review of the rent arrears payment:
- The landlord advised that the policy from Kainga Ora is that rent arrears payments represent 10% of the actual rent. The landlord is consenting to the weekly payment of $19.00, which is below the policy requirements. The landlord seeks to review the rent arrears repayment plan in 6 months’ time, with a view to the arrear’s payments rising to $23.00 per week.
