Reasons

This Tenancy started in May 2021. The Tenant provides a home for his two daughters and young grandson. He is also working hard to make a better life for himself and his whanau and is part way through a carpentry apprenticeship. Unfortunately, he has fallen behind in his rent. He is hopeful that, once he gets his ticket, his financial situation will improve, but at the moment he does not earn enough as an apprentice to catch up.

The Landlord has been supportive of the Tenant throughout this tenancy but has reached the point where it considers that the tenancy should be terminated due to the unpaid rent. The Landlord therefore seeks to terminate the tenancy and obtain possession of the premises due to unpaid rent. It also seeks orders requiring the Tenant to pay the rent arrears and reimburse the $28 Tenancy Tribunal filing fee. The rent arrears

The Landlord has provided a rent summary showing rent payments throughout the tenancy. I accept that rent summary as an accurate record of the rent payments during the tenancy.

The rent summary shows that, as at the date of this decision, the Tenant had unpaid rent arrears of $2,750. The Tenant accepts that he owes that amount, so I order that the Tenant is to pay rent arrears of $2,750 to the Landlord.

The Tenant has verbally agreed to repay the rent arrears within four weeks. I make no order requiring the Tenant to pay the arrears within that time, but I do note that the Landlord agreed to defer taking enforcement action for four weeks to enable that to happen. The Tenant should understand that if he does not make the payments as offered, the Landlord is within its rights to take enforcement action, which will likely lead to an increase in the debt he owes. Termination of tenancy and possession

Because the rent is in arrears by at least 21 days, I must make an order terminating the tenancy. 1 I see no basis for making this order conditional. 2 The Tenant told me that he cannot keep up with the rent payments, so I cannot be satisfied that a similar breach will not occur in the future.

I order that the tenancy is terminated under section 55(1)(a) of the Residential Tenancies Act 1986. The parties have agreed that the termination should be effective from the end of 1 March 2026, to give the Tenant time to clean the 1 Residential Tenancies Act 1986, section 55(1)(a). 2 Under section 55(1A) of the Residential Tenancies Act 1986, I can make a termination order conditional, but only if I am satisfied that the tenant will pay the rent within a specified time and that it is unlikely that the tenant will fail to pay the rent in the future. premises and move out in an orderly way. Possession is also granted to the Landlord, 3 effectively immediately after the tenancy is terminated. Filing fee and name suppression

The Landlord has been wholly successful in its claim, so it is entitled to recover the filing fee. The Landlord does not seek name suppression, so I make no suppression orders for the Landlord. The Tenant does seek name suppression. I must consider whether it is in the public interest to grant that suppression.

On one hand, there is a public interest in publicising the names of tenants who have had a tenancy terminated due to unpaid rent. Such information is of relevance to future landlords. On the other hand, in some cases the public interest lies in protecting the identity of an unsuccessful party where publication has a disproportionate impact on a tenant or their dependant whanau. In this case, the Tenant is doing his best to provide for his young and growing whanau, while also working hard to earn his carpentry ticket. Publication of his name may undermine that progress, particularly if it leads to the Tenant being unable to secure future accommodation for himself and his whanau.

On balance, weighing up those competing interests. I see a real public interest in suppressing the Tenant’s name and identifying details.

This suppression order is subject to one condition. The Landlord may provide a copy of this decision to any landlord or accommodation provider who seeks a reference for the Tenant, including by identifying the Tenant. In doing so, the Landlord must advise that landlord or accommodation provider that the Tenant’s name and identifying details are otherwise suppressed and must not be published or shared. The Landlord must not otherwise identify the Tenant in connection with this decision or its outcome. Bond
