[The tenant/s] owes T and T Property Management Limited as Agent for LFBM Sentry Holdings Trust $4,452.73 (“the debt”) as follows:
[The tenant/s] must pay rent and the debt as follows: a. by a payment of $1,750.00 no later than Friday 20 February 2026 being: i. $350.00 for the weekly rent due 20 February 2026; and ii. $1,400.00 towards the debt. b. by payments of $400.00 starting Friday 27 February 2026 and continuing every Friday after that until the arrears are paid in full, being; i. $350.00 for the weekly rent; and ii. $50.00 towards the debt.
No later than Friday 27 February 2026 the tenant must provide to the landlord a copy of the Tribunal’s Order in application 5408470, confirming that the Tribunal has directed the Bond Centre to pay the tenant’s bond of $1,320.00, held in respect of that tenancy, to the tenant.
The tenant must pay the bond referred to in Order 3 to the landlord within 48 hours of it being paid to her by the Bond Centre.
If the tenant fails to pay rent and rent arrears within 2 working days of the due dates in Order 2 or if the tenant breaches the conditions set out in Orders 3 and 4: a. the tenancy at Unit/Flat Flat 1, 57 Kana Street, Mataura, Mataura 9712 will terminate and the landlord will have immediate possession of the premises. b. the balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

Both parties attended the hearing which was held by teleconference.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
The tenant says that she will be able to pay rent and the debt by an immediate payment of $1,400.00 which she has arranged with WINZ, by paying the landlord the bond of $1,320.00 held in respect of her previous tenancy, which is the subject of a Tribunal hearing scheduled for 23 February 2026 and by paying the remaining debt off by weekly payments of $50.00 in addition to the weekly rent.
The landlord agrees not to seek immediate termination if those conditions are met.
I have granted a conditional termination order on those terms.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
Because T and T Property Management Limited as Agent for LFBM Sentry Holdings Trust has wholly succeeded with the claim I must reimburse the filing fee.
