Should the tenancy be terminated?
- Rent was at least 21 days in arrears on the date the application was filed, being 19 December 2025. The tenancy is still in rent arrears as at today’s date. Therefore, the Tribunal has no discretion, it must terminate the tenancy on the landlord’s application in these circumstances. The tenancy is terminated and possession granted to the landlord at 12noon on 20 February 2026. See section 55(1)(a) Residential Tenancies Act 1986.
