Order
- Mariana Ellen Bradshaw and Isla Vipperman must pay Vision Property Management Limited As Agent For Tim Ten Hove $1,040.00 immediately, calculated as shown in table below.
Reasons
- Ms Edwards and Ms Williams, representing the landlord, and Ms Bradshaw, one of the tenants, and her support person, Ms Elton, all attended the video conference hearing. The other tenant, Ms Vipperman, did not join the hearing as per the instructions in the Notice of Hearing so did not attend the hearing. Ms Bradshaw said she did not speak for Ms Vipperman. As Ms Vipperman was served, the hearing proceeded in her absence.
- The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The landlord said the tenants did not leave the premises reasonably clean.
- The landlord claimed for cleaning costs and replacing light bulbs at the end of the tenancy. After a discussion between the parties during the hearing, the landlord agreed to remove the claim to replace light bulbs and the tenant consented to the landlord’s cleaning claim in the amount of $1,012.00.
- The amounts ordered are proved. Filing fee
- Because Vision Property Management Limited As Agent For Tim Ten Hove has been successful with the claim I must reimburse the filing fee.
