An application for suppression has been made in this case, and the Tribunal orders suppression of both parties’ names and identifying details.

Reasons

The parties attended the hearing which was held by videoconference.
This was a rehearing of the Tribunal’s Order dated 23 March 2026 “March Order”), which is replaced by this Order.
The March Order was made without hearing from the landlord.
Having heard from both parties, I am satisfied that in compensating the tenants for the whole of the rent paid for the period from 1 December 2025 when the tenancy started, to 15 December 2025 when the beds were provided, the March Order did not sufficiently allow for: a. the tenants’ recognition and acceptance that those chattels needed to be procured, so there might be a short delay; or b. the tenants having some benefit from being able to access the premises and begin moving belongings in during that time.
The fundamental finding remains the same. The landlord contracted to provide the premises with those chattels and for 2 weeks did not.
The tenants should be compensated for loss caused by that breach. In these circumstances, the tenants’ loss of amenity is not equal to the difference between rent charged for the premises with those chattels and without them.
Having now heard from the landlord as well as from the tenants again, I find that there was an acceptance that it might take a few days to procure and provide those chattels. I would not consider the landlord to have been in breach until the chattels were still not in place by the Wednesday after 1 December 2025 when the tenancy began.
I generally accept the tenants’ position that there was no point in moving things into the premises when, because there were no beds, they were having to stay elsewhere.
There is though some benefit to a tenant in having free access to premises before moving in.
To allow for those considerations, the compensation awarded is reduced to $600.00
Because [The applicant/s] have substantially succeeded with the claim I reimburse the filing fee.
