Order
- Dena Henry and Marshall Glenn must pay Eden Buddha Whetu Limited $8,368.00 immediately, calculated as shown in table below.
- The Bond Centre is to pay the bond of $2,160.00 (BN-25093229) to Eden Buddha Whetu Limited immediately.
- The tenants’ application is dismissed.
Reasons
- The landlord attended the rehearing via remote video conference. The tenants did not join the rehearing via the video or telephone link as instructed in the notice of hearing.
- The Tribunal also made attempts to contact the tenants on the 3 telephone numbers provided with the application. All 3 telephone calls went unanswered. The rehearing continued in the absence of the tenants.
- The tenants did not attend the hearing at the scheduled time, request an adjournment, or notify the Tribunal the matter has settled. See sections 78(1)(i) and 92(1) Residential Tenancies Act 1986.
- The tenants’ application is dismissed for non-attendance.
- The landlord has applied for rent arrears, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
How much is owed for rent?
- The tenancy ended on 24 February 2026. The landlord provided rent records which prove the amount owing at the end of the tenancy.
- The landlord confirmed during the hearing that the tenants moved out of the property on 24 February 2026. Possession has now been returned to the landlord.
- The landlord provided an updated rent ledger during the hearing confirming the rent arrears claimed. Having sighted the landlord’s rent evidence I am satisfied that the tenants are responsible for the rent debt.
- The claim for rent arrears is proven.
- Because Eden Buddha Whetu Limited has wholly succeeded with the claim I must reimburse the filing fee.
