Because the landlord has been wholly successful in their claim, I must order the tenant to reimburse the filing fee.

The landlord did not seek name suppression however, the tenant did. I have a discretion to grant the tenant name suppression under section 95A(4) of the Residential Tenancies Act 1986. This section requires me to consider the interests of the parties and public. In Lewis v Wilson & Horton [2003] 3 NZLR 546 at paragraph 43, The Court of Appeal endorsed the approach taken in the High Court, which held that: ...the principle of open justice dictates that there should be no restriction on publication of information about a case ‘except in very special circumstances.’

I have carefully considered the reasons the tenant gave for seeking name suppression however, in the circumstances, I will not set those reasons out here. 1 Residential Tenancies Act 1986, section 55 and 56(2).

There is a strong public interest in publication of the tenant’s name. This is because rent arrears are high. Prospective landlords have an interest in knowing the tenant’s rent arrears history when considering whether to offer the tenant a tenancy.

I find the tenant’s concerns can be appropriately managed by ordering suppression of the tenancy address and landlord’s name. This eliminates any means of identifying the location of the tenant by disclosing the tenancy address or landlord’s name. Mere publication of the tenant’s name in the absence of this other information is very unlikely to lead to identification of the tenant’s current address.

I have considered the interests of the tenant and weighed them against the public interest. I find the tenant’s concerns can be appropriately mitigated by ordering suppression of other identifying details. In these circumstances, the public interest in publication outweighs the tenant’s interest in suppression.

For these reasons, I decline to grant the tenant name suppression.
