The Bond Centre is to pay the bond of $1,845.00 ([Bond number suppressed]) to [The landlord/s] immediately.

Reasons

The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenant, nor any call in to the conference by one of the telephone numbers provided on the Notice of Hearing. I was satisfied adequate service had completed and I continued with the hearing.
The tenancy has now ended. The landlord sought rent arrears, the bond and the application filing fee.
The tenancy ended 29 December 2025. While the tenant had family remove most of her possessions, a heavy duty “bike lock” was then placed around the entrance gates, preventing later landlord entry.
A series of messages between the parties confirm this and also how it would be resolved. The tenant failed to remove the lock until sometime before 12 January 2026 when the landlord saw it had been removed.
The landlord sought rent until this date but as discussed at the hearing, the messages confirm the tenant exit and after a short timeframe as agreed for the removal of the lock it was open to the landlord to use bolt cutters or such to remove the lock, mitigating any subsequent loss (see s 49 RTA). Considering this and the impeded entry from 29 December 2025, I consider it appropriate to award further rent arrears but capped to 1 January 2026.

The genesis of this application was a prior withdrawal under s 56B and the subsequent remaining tenant notice to terminate.
Suppression is ordered.
