[Ms H] attended the hearing for the landlord. One of the tenants, [Mr R], also attended. The other three tenants were phoned on the numbers provided but the call to the number ending in 966 went to voicemail, there was no response to the call to the number ending in 696, and the call to the number ending 015 disconnected soon after the call was answered.
The landlord has applied for rent arrears and reimbursement of the filing fee.
The landlord initially filed the application against all four tenants, but [Ms H] confirmed at the hearing that the landlord only wished to claim against the tenant who she said owed the outstanding rent, Mr Tipene. Both [Mr R] and [Ms H] said that Mr Tipene had used the rent moneys paid by the tenants for the tenancy for his own purposes. [Ms H] therefore confirmed that the application could be withdrawn against the other three tenants.

The landlord provided a rent record that supports the amount owing by Mr Tipene. [Mr R] accepts that the amount claimed is the amount outstanding.
The landlord has been successful in his claim and is therefore entitled to payment of the Tribunal application fee. Suppression
The landlord applied, in his application, for a suppression order. As the landlord has been fully successful in his claims, he is entitled to an order pursuant to section 95A of the Residential Tenancies Act 1986. I therefore order that his name and identifying details be suppressed.
[Mr R] also sought suppression of his name and identifying details and those of the other two ‘innocent’ tenants. Section 95A(4) of the Act provides that the Tribunal may order that a party’s name or identifying particulars not be published after having regard to the interests of the parties and the public interest.
I consider that this is an appropriate case to exercise my discretion in [Mr R, Mr C and Mr M’s] favour and order suppression of their names and identifying details. Given the particular circumstances in which the debt arose, I consider that the prejudice to these three tenants if their names and identifying details were published far outweigh any public interest in the publication. I record that [Ms H] did not object to a suppression order in favour of [Mr R, Mr C, and Mr M].
