Reasons
- The landord attended the hearing. There was no appearance for the tenant.
- The landlord has applied for compensation following the end of the tenancy which terminated on 10 November 2025 after the tenant gave notice.
- The landlord provided copies of entry and exit inspections and a list of amounts claimed through their maintenance and works system.
- The following matters that were in the application were withdrawn: a. cleaning and scrubbing kitchen cupboards b. pool gate hinge and gate latch c. slash and dispose of grass d. window trim seal.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish. See section 40(1)(e) Residential Tenancies Act 1986.
- The photographs show that the tenant had not done any cleaning and the oven had not been cleaned in some time. She abandoned a large number of items and left piles of rubbish. The landlord had to dispose of 19 cubic metres of items from the interior and 7 cubic metres of rubbish from the exterior.
- The amounts ordered are proved.
Is the tenant responsible for the damage to the premises?
- A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
- Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for. See section 49B(1) RTA.
- Damage is intentional where a person intends to cause damage and takes the necessary steps to achieve that purpose. Damage is also intentional where a person does something, or allows a situation to continue, knowing that damage is a certainty. See Guo v Korck [2019] NZHC 1541.
- There were several small areas of damage. There were small holes the walls in the hallway and living room. There was a hole in the wardrobe door and a knob missing. There was damage to the door into bedroom 2 and a deep scratch in the wardrobe door in the hallway.
- The amounts ordered are proved.
- Because Kāinga Ora–Homes And Communities has wholly succeeded with the claim I must reimburse the filing fee, but have not included it in the order above, given the landlord will not enforce it.
