The tenancy began on 21 September 2025 and was for a fixed term of one year.

On 14 November 2025 the landlord discovered that the police had executed a search warrant on 11 November 2025 and had found that the property was being used as part of a cannabis growing operation.

The landlord produced photos showing that multiple holes had been cut in the walls, ventilation filters were installed inside the ceiling cavity, the electrical wiring in each room had been tampered with, the bedroom doors had been removed and modified with large holes cut in them and the main gate had been damaged.

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) RTA.

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

The tenants left considerable mess and damage as shown in the photos produced by the landlord.

The landlord did the rubbish removal and cleaning together with her husband, which took over 100 hours, for which they seek compensation of $2,750. I consider this claim to be reasonable given the condition of the property and the amount of rubbish left behind.

The landlord sought $4,000 for repairing doors, walls, ceilings and electrical repairs, and produced a breakdown of work done and bank statements showing the amount paid.
