By weekly payments of $530.00, being $520.00 for rent and $10.00 for the debt. Payments will be every Wednesday, with the first payment on Wednesday 13 May 2026 and continuing until the debt is paid in full.

Reasons
- Only the applicant landlord attended the hearing which took place by videoconference.
- The landlord advised that she had received a message from the tenant that she may not be able to attend but the parties had been in communication regarding a payment plan.
- The landlord has applied for termination of the tenancy, rent arrears and reimbursement of the filing fee. The tenant wants to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- The property manager advised that the tenant has informed her that she will pay $1200.00 this Wednesday and from next week will pay $10.00 extra towards the debt each Wednesday.
- As the tenant pays rent on a Wednesday the Tribunal declares that the rent week will now run from Wednesday to Tuesday. Rent is ordered to Tuesday 5 May 2026 with the next week’s rent falling due on Wednesday 6 May 2026 to coincide with the tenant’s next payment.
- The landlord consents to a conditional termination order.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
- Because THG Property Management Limited As Agent For A Gray Homes Ltd has wholly succeeded with the claim I must reimburse the filing fee.
