Reasons

Both parties attended the hearing.

The landlord has applied for possession of the premises occupied by the tenant, rent arrears and refund of the bond. There is a standard tenancy agreement for the boarding house unit.

The tenant disputes the claims. He says that he has not been paying rent because there was an arrangement that he carry out works to the wider property and he has not been paid for this. The landlord disputes that this was the arrangement and says that any arrangement for works to be carried out is separate to the rent owed under the tenancy agreement.

The tenant also raises issues around whether the property is a boarding house, the quality of the premises and issues with other tenants at the premises. No cross application has been filed. The law

On 12 November 2025 the landlord gave the tenant a notice with respect to rent arrears. This notice required payment of the outstanding rent within 14 days.

The rental arrears were not paid and on 1 December 2025 the landlord issued a notice terminating the tenancy. The notice stated that although only 48-hours was needed, they had extended the notice period to 7 days, and the final date of the tenancy would be 8 December 2025. The tenant remains at the property.

The Residential Tenancies Act 1986 (RTA) states that the landlord of a boarding house may terminate a boarding house tenancy on 48 hours’ notice if the landlord has, by written notice to the tenant, required the tenant to pay any rent in arrears within a period of not less than 10 days, and the tenant has failed to make that payment. 1

The RTA further provides that a landlord may apply to the Tribunal for a possession order if they have given notice under section 66U of the RTA, and the tenant has not quit the premises within the specified period.

The RTA is clear that if the Tribunal is satisfied that the notice of termination was properly given and has not been withdrawn, it must make an order granting possession of the premises to the landlord. 2 Discussion

On review of the evidence, I am satisfied that the notice of termination was properly given, has not been withdrawn and the tenant has not quit the premises. 1 Residential Tenancies Act 1986 (RTA), s66U(1)(b). 2 RTA, s66Y(2).

Accordingly, the landlord is entitled to an order for possession of the premises, there is no discretion afforded to the Tribunal in the RTA and the issues raised by the tenant do not change this.

The landlord also claims for the rent owing of $8,038.36 through to 25 February 2026. There is inadequate evidence to suggest that this rent is not owed. It is detailed in the tenancy agreement, and I have seen no written evidence that proves a different arrangement was in place for rent payments.
