Order
- The tenancy of Odean Thompson at Unit/Flat Unit 1009, 22 Nelson Street, Auckland Central, Auckland 1010, Heritage Tower, level 10 is terminated, and possession is granted to Kany Enterprises Limited, at 11:59pm Tuesday 10 February 2026.
- The Bond Centre is to pay the bond of $2,040.00 (BN-17590339) to Kany Enterprises Limited immediately.
- Odean Thompson must pay Kany Enterprises Limited $1,048.00 immediately, calculated as shown in the table below:
Reasons
- The landlord attended the hearing via remote video conference. The tenant did not join the hearing via video link or by calling in as prescribed in the notice of hearing. The hearing continued in her absence.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears and refund of the bond.
- The landlord also provided evidence of anti-social behaviour notices having been served on the tenant, along with breach notices for overdue rent.
Should the tenancy be terminated?
- Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
- Rent is at least 21 days in arrears at the hearing date. The tenancy is terminated.
How much does the tenant owe?
- The landlord provided rent records which prove the amount owing at the end of the tenancy. Having sighted the landlord’s evidence I am satisfied that the tenant is responsible for the rent debt.
- The claim for rent arrears is proven.
- Because Kany Enterprises Limited has wholly succeeded with the claim I must reimburse the filing fee.
