Reasons

The landlord represented by Ms Belu attended the hearing which was held by video conference. Neither of the tenants sought to be admitted to the hearing.
The landlord has applied for termination of the tenancy, rent arrears, reimbursement of the filing fee and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy is $7,650.00.
The landlord’s original application form to Tenancy Services does not seek termination of the tenancy. Today Ms Belu explained that was because she originally hoped to resolve the dispute at mediation without terminating the tenancy. However, no rent has been paid since 9 December 2025, and mediation was vacated. Ms Belu said the application to Tenancy Services was amended on about 29 January 2026 to include a claim for termination of the tenancy. Ms Belu said she visited the tenancy address two weeks ago, and the tenants were making preparations to move out of the property.
It is clearly not in anyone’s interests to allow a rent debt to continue to accumulate.
I am satisfied on the balance of probabilities that the tenants are aware this application includes a claim to terminate the tenancy.
Because A1 Property Managers Limited As Agent For Ms V Webb has wholly succeeded with the claim I must reimburse the filing fee.
