Reasons

The landlord’s representatives attended the hearing which I conducted by video. The tenant did not attend.
The landlord has applied for termination of the tenancy for abandonment, rent arrears, refund of the bond, and the filing fee.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date 1 . A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 26 December 2025 the landlord became aware that the tenant had abandoned the premises. An inspection showed that most of the tenant’s belongings had been removed and the power had been disconnected.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The tenancy was a fixed term tenancy to 11 January 2026 following which it became a periodic tenancy.
The tenant is liable for rent until the end of the fixed term tenancy and then for 3 weeks’ rent in lieu of notice once the tenancy became a periodic tenancy.
The landlord provided rent records which prove the amount of rent owing at the end of the tenancy and the amount of rent in lieu of notice.
As the application is successful, I have reimbursed the landlord the filing fee.
