The tenancy commenced on 29 May 2025 and is current. Late last year the landlord made an unsuccessful attempt to terminate the tenancy. While termination was avoided, the tenant was warned that it was in their best interests to meet their obligations under the agreement and that, although each case would be dealt with on the facts, if the landlord were to serve subsequent notices that were not remedied, the outcome may be different.

On 24 December 2025, the landlord issued the tenant with a 14-day notice to remedy rent arrears, remove a dog kept at the property contrary to the terms of the agreement, maintain the property in a reasonably tidy condition and remove all rubbish, and cease operating a business from the property.

The landlord claims that none of the breaches have been remedied. Law

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate (see s 56(1) Residential Tenancies Act 1986 (Act)).

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

Where the breach is not capable of remedy, the landlord is not expressly required to serve a 14-day breach notice on the tenant to remedy the breach, although the Tribunal may consider whether a warning should have been given when determining whether it would be inequitable to refuse to terminate.

Section 56(2) of the Act provides that if a landlord applies to terminate a tenancy for a breach under section 56(1), and at the time of the hearing the landlord could have applied for termination under section 55 (rent arrears of more than 21 days), the Tribunal must treat the application as if it had been made under section 55. Analysis and decision

The landlord’s rent summary shows that the tenant’s last rent payment was received on 18 December 2025. As at today’s hearing, the rent is at least three weeks in arrears, in fact, it is eleven weeks in arrears. Section 56(2) of the Act applies. The tenancy is terminated, and possession granted to the landlord immediately. I order the rent arrears owing to the end of the tenancy.

Regarding the other breaches referred to in the 14-day notice, these are dismissed as no evidence has been produced. Costs

Section 95A of the Act provides that on the application of a party that has been wholly or substantially successful in proceedings, the Tribunal must order that the name or identifying particulars not be published, unless the Tribunal considers that it is in the public interest to publish the names of the parties, or is justified because of the parties’ conduct, or any other circumstances of the case.

The landlord seeks suppression of the tenant’s name. The landlord provides accommodation to people who have recently been released from prison and need a stable address. While I am satisfied that the facts and reasoning of this decision are in the public interest, I am not satisfied that this interest necessarily extends to the name of the tenant. There is a risk of stigma to the landlord and those who they accommodate if the tenant were identified. Upon careful consideration, I am satisfied that there are sufficient grounds to depart from the principle of open justice and exercise the discretion in section 95A (4). The Tribunal also orders suppression of the tenant’s name.
